Welcome to Kins. These terms govern your use of the service. By creating an account or using Kins, you accept these terms. If you do not agree, do not use the service.
1. Service Description
Kins is a social genealogy platform (web + mobile apps for iOS and Android) that lets you build, share, and enrich your family's history. The service includes: creating family trees, adding people and relationships, importing photos and voice memos, sharing with other family members, and accessing a public API for published trees.
2. Account Creation
To use Kins, you must create an account with a valid email address. You warrant that the information provided is accurate and that you are at least 13 years old (16 in certain EU countries depending on local legislation).
You are solely responsible for the confidentiality of your password. Notify us immediately at hello@kins.africa if you suspect unauthorized access.
3. User Content
3.1. Ownership
You retain ownership of the content you add to Kins (trees, photos, audio, posts). We do not claim any ownership rights over this content.
3.2. License You Grant Us
To provide the service, you grant us a non-exclusive, worldwide, royalty-free license to host, store, transmit, display, and technically adapt your content. This license terminates when you delete your content or account (except where legal obligation requires us to retain a copy).
3.3. Responsibilities
You warrant that:
- You have the right to add each piece of content (photo, information about a person) to Kins
- For living persons, you have obtained their consent before adding them to a tree, especially for sensitive information (health, religion, etc.)
- Your content does not violate any law, infringe on third-party rights (copyright, privacy), or constitute defamation
4. Family Privacy
Genealogy touches on sensitive information about third parties. Kins provides privacy tools (private trees by default, per-member access controls), but responsible use of the service is your responsibility.
If a person added to a tree requests deletion of their data, we will comply, even against your wishes as the tree administrator.
5. Prohibited Uses
It is prohibited to use Kins to:
- Store or distribute illegal, hateful, defamatory, discriminatory content, or content harming human dignity
- Spy on, harass, or harm others
- Attempt to compromise the security of the service (mass scraping, bypassing limits, attacks)
- Create multiple accounts to bypass free tier limits
- Resell or redistribute the service without our written consent
In case of violation, we may suspend or delete your account without notice.
6. Tiers (Free, Kins+, Pro, Heritage)
Kins offers a free tier sufficient for most family use cases, and paid tiers (Kins+, Pro, Heritage) with extended quotas. Tier details are available on the pricing page.
Payments are handled by our payment provider (to be completed). Subscriptions auto-renew unless canceled at least 48h before renewal.
For cancellation within 14 days of a new payment (EU applicable law), send a request to hello@kins.africa.
7. Public API
Kins offers a public API for published trees (isPublic = true). Access is via personal API key with tier-defined quotas. API usage terms are documented in the Kins dashboard.
8. Service Availability
We strive for high availability, but Kins is provided "as is" with no guarantee of uninterrupted operation. We may interrupt or modify the service for maintenance, updates, or technical reasons.
9. Limitation of Liability
To the extent permitted by law, Kins shall not be liable for indirect damages (loss of data, loss of business, etc.) resulting from use or inability to use the service.
This limitation does not apply in case of willful misconduct, intentional fault, or gross negligence on our part, nor to rights guaranteed to you by law as a consumer (in particular legal warranty of conformity and warranty against hidden defects).
10. Termination
You may delete your account at any time from the app settings. We may terminate your account in case of violation of these terms, notifying you by email.
11. Modifications
We may update these terms. In case of substantial modification, we will notify you by email and/or via in-app notification at least 30 days before the changes take effect. If you continue to use Kins after the update, you are deemed to have accepted the new terms.
12. Governing Law and Jurisdiction
These terms are governed by French law. Any dispute shall be submitted to the competent courts of Paris, subject to mandatory consumer protection rules of your country of residence.
